Even if you manage to have a fairly amicable settlement, you’ll probably need some legal advice at some point. It’s always worth talking to other people who’ve experienced separation for advice, but remember that everybody’s situation is unique.

Legal advice is not the same thing as a court battle. Good legal advice is about providing options and information, and should be geared towards a settlement that avoids legal action if possible.

If your former partner has a lawyer, their lawyer will be working hard to obtain the best possible outcome for them. But make sure you don’t sign anything until you’ve had legal advice yourself on how the law applies to your situation.

Top tips for dealing with lawyers

  • Find a lawyer who specializes in family law – many will give you a free initial consultation.
  • Make sure you feel comfortable with your lawyer. The most expensive lawyer won’t necessarily be the best, and the lawyer with the lowest rates won’t necessarily work out cheaper in the end.
  • Make sure you take all the relevant documents with you for your first meeting. These may include property details, any shares or savings you might have, details of your pension and any debts you might have.
  • Prepare a document setting out the essential details of your marriage, including the date you married and the names and dates of birth of you and your children. This will help you maximize the time you have at your first meeting.
  • Use a tape recorder or ask a friend to take notes during meetings – you may get engaged with the conversation and miss vital points.
  • Get a clear estimate of costs at every stage – make sure you understand the method of payment and any charges that may be added.
  • Make sure you understand the likely outcomes
  • Don’t be afraid to ask questions – your lawyer is there to help you, not bamboozle you with legalese.
  • Make sure you respond to requests quickly – you can also reduce costs by preparing some information by yourself.
  • If you’re not happy with the advice you’ve been given – get a second opinion.
